PROCEDURE OF VIETNAM WORK PERMIT EXTENSION – FOREIGNERS MAY CONCERN

Vietnam Government has tried to carry out many policies and projects to co-operate with the international economy. In recent years, there are a great number of foreign investors and businessmen coming to Vietnam to work due to a high demand of foreign workforce. After working in Vietnam for a long time, your Vietnam Work Permit is expired but you still would like to stay here more than two years. Of course, you can extend your Work Permit by extension service. Extending it may leave such many questions, but we are here today to help you answer these issues you are concerned. Let’s follow us.

[i] – 3 CONDITIONS TO EXTEND VIETNAM WORK PERMIT

Foreigner still work in the same previous company
Foreigner still work as the same job position
His/ her sponsor company still would like to sponsor the foreign employee

Please keep in your mind that you have to renew or extend your Work Permit 30 days before the date expiration of your Vietnam Work Permit since if you have only 29 days left until your Work Permit is expired, you cannot issue your Work Permit Extension in Vietnam. To be more carefully, you should prepare the dossier before 45 days in case any problem happens to you in terms of dossier or sponsor company.

[ii] – PROCEDURES FOR WORK PERMIT EXTENSION

Step 1: Submit application to explain the need to use foreign workers with the Department of Labor – Invalids and Social Affairs outside the country expected to work

At least 30 (thirty) days in advance, from the date of the expired work permit, the employer or Vietnamese partner must submit a dossier of application for approval of the position to recruit foreign workers or explain the need to use foreign workers to apply for a Work Permit with the Department of Labor, War Invalids and Social Affairs outside the country expected to work. If the Labor Department issues a written reply to approve the position of the foreign worker, the enterprise submits the dossier as prescribed to the Department of Labor – Invalids and Social Affairs to re-issue and extend Vietnam Work Permit.
The position and title of the foreign worker still remains the same as the information on the granted and valid Work Permit;
There is a written approval of the position issued by the Department of Labor – Invalids and Social Affairs.

Step 2: Submit application for Renewal of Vietnam Work Permit in accordance with the provisions of Decree 11/2016-CP

Within 15 (fifteen) days from the date of receiving the written approval of the position granted by the Department of Labor, War Invalids and Social Affairs, the dossier of extension of the work permit must be submitted;
Processing time is from 5 to 7 working days

[iii] – REQUIRED DOCUMENTS FOR VIETNAM WORK PERMIT EXTENSION

You have to satisfy these following documents to issue your Work permit:

Request form for work permit extension from the employer in accordance with regulations of the Ministry of Labor – Invalids and Social Affairs;
Health check certificate must be issued by the hospital/clinic appointed by DOLISA
Three recent passport-sized photos (These photos should be taken with bareheaded, frontal view, showing the face and ears clearly, without glasses, and on a white background and within the last 6 months from the date on which the expat lodges the application dossier for work permit)
The original work permit (the work permit is valid for at least 05 days but not more than 45 days)
People’s Committee approval
Notarized true copy of labour contract

[iv] – THE VALIDITY OF VIETNAM WORK PERMIT EXTENSION
The validity period of a work permit is equal to the duration of the labor contract to be signed as far as the period is less than 02 years.
